Bozic et al: Prosecution's Material Evidence

29 November 2007

The Court of BiH does not admit, as material evidence, the exhumation reports presented by the Prosecution

At the trial of four former members of the Republika Srpska Army (VRS) Military police, who are charged with having committed crimes in Bratunac in July 1995, the Prosecution of BiH continued presenting material evidence, items of which was not admitted by the Trial Chamber.

Prosecutor Kwai Hong Ip proposed that the Court admits, as material evidence, a report on exhumations from graves in Budak and Glogova 2, Zeleni Jadar, as well as a document containing the number of buses used for transportation of civilians to other locations after the fall of Srebrenica in July 1995. The prosecution received these documents from the International Criminal Tribunal for the former Yugoslavia
(ICTY) in The Hague.

However, the Trial Chamber rejected the proposal. Chairman Stanisa Gluhajic clarified the decision by saying that "the estimation of the number of bodies exhumed from these graves is not necessary". The judge reminded the Prosecutor that the document on the number of buses was rejected at an earlier hearing, "because it is not clear who signed the mentioned document".

Zdravko Bozic, Mladen Blagojevic , Zeljko Zaric and Zoran Zivanovic, former members of the military police squad with the VRS Bratunac Brigade, are charged with having participated in the murder, maltreatment and cruel treatment of Bosniaks detained in an elementary school in Bratunac after July 11, 1995.

Ip also presented some other documents received from The Hague, which refer to "communication between police forces and individual VRS [members] on July 13, 1995". The documents indicate that "the activities are continuing", "the area should be cleared of enemy forces" and "evacuation should be ensured". These documents were admitted as material evidence.

The trial is due to continue on December 4.
