12 February 2010 Testifying for the Prosecution of Bosnia and Herzegovina, Zlate Ravnjak and Omer Kmetas say that indictee Darko Dolic raped one person and physically abused village residents in Druzinovici in August 1993.
"Darko Dolic was youngish and swarthy at the time. He was neither fat nor skinny. He was dressed in a multicolor suit. When he arrived in the village he ordered me, Omer and Djula Kmetas to walk towards the house of Zlatif Kmetas, Omer's father. On our way to the house he beat us with a rifle," Ravnjak said. She said she did not know Dolic's name at the time, but that Suljo Kmetas, Omer's brother, had told her later that his name was Darko.
Dolic, a former member of the "Jastrebovi" ("Hawks") Reconnaissance Squad with the "Rama" Brigade of the Croatian Defence Council, HVO, is charged with torture, inhumane treatment and rape as well as the pillaging of Bosniak property in Prozor municipality.
The Prosecution of Bosnia and Herzegovina charges him with having participated, in collaboration with a Zoran Calis, in physical abuse and robbery of civilians, who had to gather, as per the indictee's order, in front of Zlatif Kmetas' house, in Druzinovici village at the beginning of August 1993.
"Dolic ordered Ajka Kmetas, Omer's mother, to tie Omer and Zlatif to two pillars in front of the house using the rope from a garden swing. Then Darko and Calis fired bullets in the air, cursed and asked us to give them jewelry. After that they started slashing Zlatif. Darko pulled his shirt up and showed us his bandaged body, saying: "Serbs did not kill me. Neither will you'," Ravnjak said.
The witness added that Dolic took 2,000 German marks from her a short time later. She said she saw Calis taking Edina Kmetas to the first floor of the house in front of which they were standing.
"When Calis came back, Dolic went to the first floor. Then I heard her scream twice. The two of them then took Zlatif away. Edina came back, crying. She was covered with blood and her shirt was torn. She said Calis and Dolic raped her. (...) We did not expect our neighbours to do that, but they did things that were even worse than the ones committed in the past war," the witness said.
The indictment alleges that Dolic and Calis forced a female person to have sexual intercourse with them in a house in which she lived with her husband and children. The indictment further alleges that Dolic first physically abused Edina Kmetas and then raped her.
The second Prosecution witness, Omer Kmetas, said that Dolic and Calis "did various kinds of things using knives" to him and his father Zlatif, adding that he assumed that they did this "only because I was a Muslim".
"While we were standing in front of my father's house, they asked for money and jewelry. I saw them taking my sister-in-law Edina to the first floor of the house. Later I found out that they raped her. I remember Zoran was a bit taller and skinnier than Darko," Kmetas explained.
The two witnesses identified the indictee in court. They said they left Druzinovici village, together with other village residents, in September 1993.
Dolic's Defence objected to Kmetas' statement, claiming that it was "tendentious and non-objective".
The trial is due to continue on February 18.
