
23 December 2009 As part of his evidence presentation, Gojko Klickovic seeks to prove that the war in Bosnia and Herzegovina was "an aggressive attack on Yugoslavia".
Klickovic presented as material evidence extracts from a publication titled "Nikola Koljevic's Wartime Diary", which was published as a serial in Vecernje novosti newspaper in Serbia.
"It objectively speaks about the conflict genesis. The conflict was imported from the West as per a scenario. They did it by means of intelligence services. The whole thing was directed. The war was an aggressive attack on Yugoslavia. (...) The Defence wants to prove that everything was controlled from abroad. Under such circumstances, the Serb people could not be an aggressor. This was just a fight for survival," Klickovic said, explaining the reasons for introducing these pieces of evidence.
The State Prosecution charges Klickovic, Mladen Drljaca and Jovan Ostojic with crimes against humanity committed in Bosanska Krupa in 1992 and a joint criminal enterprise, which, as stated in the indictment, began in the summer of 1991.
Nikola Koljevic, wartime Deputy President of Republika Srpska, committed suicide in 1997.
Klickovic presented an article published in NIN, a Serbian weekly magazine, under the title "Anatomy of a Joint Criminal Enterprise", authored by US attorneys Alan and Nathan Dershowitz. In the article, they say the joint criminal enterprise term is "the Hague Tribunal's fabrication".
"This issue appears in my indictment as well. This proves that the indictment was made in a way, which has nothing to do with the law. It has as much to do with the law as a brass band has to do with a philharmonic orchestra. All indictments against Serbs are based on joint criminal enterprises and persecutions. It is almost
impossible to prove those two crimes. Here, they are trying to turn a basic human right into a criminal act. The indictment writers have gone too far," Klickovic said.
The first indictee began presenting evidence in April 2009. He has introduced a total of 215 pieces of material evidence to date.
The next hearing is due to take place on January 26, when Klickovic's Defence will examine a new witness.
