
19 November 2009 Due to the death of the indictee the State Court is to discontinue the trial for crimes committed in Tuzla.
Faruk Prcic, former Commander of the Engineering Squad with the Second Corps of the Army of Bosnia and Herzegovina, who is charged by the State Prosecution with crimes against civilians committed in the Tuzla area, died at the age of 71 on November 17 this year.
"Once it receives a certificate from the death registry, the Court will render a decision on discontinuation of the trial of Faruk Prcic," the Court of Bosnia and Herzegovina told Justice Report.
The indictment alleged that from June to October 1992 Prcic participated in the unlawful detention, torture and inhumane treatment of Serb prisoners in the premises of the Mining Institute in Tuzla.
The Prosecution considers Prcic responsible for having failed to prevent or punish the perpetrators of the abuse of detainees committed by members of his unit and other members of the Army of Bosnia and Herzegovina, over whom he "had actual control".
The State Court confirmed the indictment on February 12, 2009. One month later Prcic pleaded not guilty to all allegations contained in its eight counts.
The indictee was waiting for the beginning of his trial while at liberty.
At a pre-trial status conference held on June 11, the Defence presented documents indicating that Prcic "suffered from a life-threatening disease", also saying that he would probably have to undergo a surgery in August.
Prior to the presentation of introductory arguments, the Trial Chamber decided to hear the opinion of a court expert concerning Prcic's state of health. However, the hearing was repeatedly postponed until November, when the Court was informed of his death.
