Week ahead: Completion of Kotor Varos crimes trial

10 October 2008  Next week the parties are due to present their closing statements, before the War Crimes Chamber of the Court of Bosnia and Herzegovina, at the trial of Marko Skrobic and the trial for crimes in Bratunac is due to be completed.

On Friday, October 17 the parties will start presenting their closing statements at the trial of Marko Skrobic. The State Prosecution charges the former member of the Croatian Defence Council, HVO, in Kotor-Varos with having participated, together with four other soldiers, in the murder of one Serbian civilian in Novo selo on July 31, 1992.
 
It was announced earlier that the parties might start presenting their closing statement at the trial of the four former members of the Military Police Squad with the Republika Srpska Army, VRS, who are charged with crimes in Bratunac in July 1995.
 
Although the Prosecution announced that it would present new pieces of evidence against Zdravko Bozic, Mladen Blagojevic, Zeljko Zaric and Zoran Zivanovic, the Trial Chamber said that it hoped that the evidence presentation would be completed in the course of next week – on October 13 and 15.
 
The Defence of Zrinko Pincic will examine new witnesses at the hearings scheduled for October 13 and 14. The State Prosecution charges the former HVO member with the multiple rape of one person in Konjic municipality.
 
The trial of Vinko Kondic, Bosko Lukic and Marko Adamovic, who are charged with abetting people to commit genocide and other crimes in Kljuc municipality, is due to continue on Monday, October 13 and Wednesday, October 15.
 
On those two days and also on Friday, October 17 the trial of Vaso Todorovic is due to take place. Following the reading of the indictment and presentation of introductory arguments, a guilt admission agreement between the indictee and the Prosecution will be considered at these hearings.
 
The indictment alleges that Todorovic, as member of the Special Police, was an accomplice in the genocide in Srebrenica in July 1995. As announced by the Prosecution at the status conference held in mid-September, in case the guilt admission is concluded the crime will be qualified as a crime against humanity.
 
The Defence of Marko Radic, Dragan Sunjic, Damir Brekalo and Mirko Vracevic is due to continue presenting evidence on October 13 and 16. The Prosecution charges the four former HVO members with participating in the mistreatment, beating, murder and rape of Bosniaks, who were detained in Vojno detention camp, near Mostar, in the course of 1993 and 1994.
 
New Prosecution witnesses are due to appear at the trial of Momir Savic on October 14. They will speak about the crimes in Visegrad, which are charged upon the former VRS member.
 
On the same day the trials are due to continue in the case of Rade Veselinovic, who is charged with crimes against humanity against the non-Serb population in Hadzici municipality, and Miodrag Nikacevic, former policeman, who is charged with crimes in Foca municipality in 1992.
 
The trial of Gojko Klickovic, Mladen Drljaca and Jovan Ostojic, charged with crimes committed in Bosanska Krupa, is due to continue on October 14 and 15.
 
The examination of Marko Samardzija, who will appear as witness before the Appellate Chamber of the State Court, is due to continue on the same days.

Samardzija was sentenced, by a first instance verdict, to 26 years' imprisonment for crimes against humanity committed in the Kljuc area. The Appellate Chamber revoked the verdict in May 2007 and ordered a retrial to be conducted.
 
On Wednesday, October 15 the trial is due to continue in the case of Ante Kovac, former member of the HVO Military Police, who is charged with crimes in Vitez. On the same day and the day after the trial of Krsto Savic and Milko Mucibabic is due to continue. They are charged with detention, torture and murder of civilians from Nevesinje, Kalinovik, Gacko and Bileca municipalities.

The Prosecution is due to continue presenting evidence against Predrag Bastah and Goran Viskovic, who are charged with murder, rape and forcible disappearances of Bosniak civilians from the Vlasenica area, on October 16 and 17.

According to the official timetable of the State Court, the trial for crimes in the Bihac area, which are charged upon Suljo Karajic, former member of the Army of Bosnia and Herzegovina, is due to continue on October 16.
 
On the same day first Defence witnesses are due to be examined at the trial of Predrag Kujundzic, charged, as former commander of "Predini vukovi" Unit with the VRS, with having participated in the prosecution, murder, rape and abuse of Bosniaks and Bosnian Croats in the Doboj area in the course of 1992 and 1993.
 
On October 17 the trial is due to continue in the case of Ratko Bundalo, Djordjislav Askraba and Nedjo Zeljaja, who are considered responsible, by the Prosecution, for detention, torture and murder of the non-Serb population from Kalinovik municipality.
