29 August 2008 As per a decision rendered by the Appellate Chamber of the State Court, two indictees, charged with crimes against Bosnian Croats from Bugojno, have been arrested again.
The Appellate Chamber of the Court of Bosnia and Herzegovina rendered a decision, terminating prohibiting measures and ordering Nisvet Gasal and Musajb Kukavica into custody again. The two men are charged with crimes against Bosnian Croats in Bugojno in the course of 1993 and 1994.
Gasal and Kukavica were arrested on August 28 this year, although the Appellate Chamber rendered a decision pertaining to "the breach of prohibiting measures," seven days ago. The details of the Court decision have not been made public.
Gasal and Kukavica were released to liberty on July 4 this year, while certain prohibiting measures were imposed on them. This decision was made after their Defence attorneys had called upon the Constitutional Court's decision, which stipulates that the Prosecutions "must prove that someone tried to influence witnesses" or, otherwise, the human rights of indictees and suspect are violated.
The Prosecution of Bosnia and Herzegovina appealed the State Court's decision, ordering the termination of custody in the case of the two indictees. The Appellate Chamber upheld the appeal and ordered them back into custody.
The State Prosecution charges Gasal, Kukavica, Enes Handzic and Senad Dautovic with crimes committed against Bosnian Croats from Bugojno, who were detained in several buildings, including the "Iskra" stadium.
The indictment alleges that about 300 detainees were held in inhumane conditions at the "Iskra" stadium. They were allegedly beaten up, mistreated and forced to perform hard labour.
The Court of Bosnia and Herzegovina terminated custody of Gasal and Kukavica in May this year, but they were rearrested, shortly after the Prosecution filed an appeal.
