Week ahead: Retrial of Kreso Lucic

29 August 2008  Next week a status conference on the Kresevo crimes is due before the Appellate Chamber of the Court of Bosnia and Herzegovina.

A status conference in the case of Kreso Lucic is due to take place before the Appellate Chamber of the State Court on September 4, 2008. The former commander of the Military Police Squad with the Croatian Defence Council, HVO, was sentenced, by a first instance verdict, to six years' imprisonment for crimes committed in Kresevo in the course of 1993.


After having upheld the appeals filed by the Prosecution and Defence, in May 2008 the Appellate Chamber revoked the verdict announced by the Trial Chamber and ordered a retrial to be conducted.


Brothers Ranko and Rajko Vukovic are due to appear before the Appellate Chamber on Tuesday, September 2, when the Court will consider the first instance verdict appeals. Under that verdict each of them was sentenced to 12 years' imprisonment for having committed the murder of civilians in Podkolun village, near Foca, in 1992.


Less than a month since Slavko Sakic denied guilt for crimes committed in Bugojno, a pre-trial status conference is due to take place in his case on September 2. The former member of the "Garavi" Special Purposes Squad with the HVO is charged with having participated in the capture and detention of Bosniak civilians in Vrbanja settlement in July 1993.


On September 1 the retrial of Marko Samardzija is due to continue. The first instance verdict announced Samardzija guilty of crimes in Kljuc municipality in the course of 1992, sentencing him to 26 years' imprisonment.


The trial of Ferid Hodzic is due to continue on September 2 and September 5, when the Trial Chamber will examine a court expert, who shall talk about the indictee's health and determine whether he is capable of following the trial. Hodzic is charged, in his capacity as commander of the Territorial Defence in Vlasenica, with having participated in crimes against Serb civilians and prisoners of war in the "Stala" detention camp.


Similar issues will be discussed at the trial of Vinko Kondic, Bosko Lukic and Marko Adamovic on September 2 and 4. The three men are charged with participating in a number of crimes in Kljuc municipality in 1992. A discussion on the further course of the trial is due to take place at these hearings. The court experts determined that Vinko Kondic was capable of following the trial for "up to two hours per day" due to bad health.


According to the official timetable of the Court of Bosnia and Herzegovina ICTY convict Momir Nikolic is due to be examined, via video link, at the trial of Milorad Trbic on September 1. Trbic is charged with genocide committed in Srebrenica in 1995. Following the conclusion of a guilt admission agreement, the Hague Tribunal sentenced Nikolic to 20 years' imprisonment for crimes committed in Srebrenica. He is currently serving his sentence in Finland.



On the same day the Prosecution is due to continue presenting evidence at the trial of Predrag Kujundzic, former leader of "Predini vukovi" Unit, who is charged with crimes in Doboj.


On that day and also on Friday, September 5 the trial is due to continue in the case of Marko Radic, Dragan Sunjic, Damir Brekalo and Mirko Vracevic, who are charged, as members of the HVO, with having committed crimes in Vojno detention camp, near Mostar.


On Tuesday, September 2 new witnesses are due to appear at the trials of Miodrag Nikacevic, former policeman charged with crimes in Foca, and Novak Djukic, former officer with the Republika Srpska Army, VRS, who is charged with shelling of Tuzla in May 1995.


On the same day and the day after the Prosecution is due to continue presenting evidence against Rade Veselinovic, who is charged, as member of the VRS military police, with having participated in crimes against the non-Serbian population in Hadzici settlement in Sarajevo.


On September 3 and 4 the trial is due to continue in the case of Krsto Savic and Milko Mucibabic, who are charged, by the State Prosecution, with having participated in the deportation, forcible disappearances, murder, rape and detention of Bosniaks from the Nevesinje area in 1992.


Nisvet Gasal, Musajb Kukavica, Enes Handzic and Senad Dautovic, who are charged by the State Prosecution with crimes in Bugojno, are due to appear before the Court of Bosnia and Herzegovina on Wednesday, September 3 and Friday, September 5.


The trial of Sreten Lazarevic, Dragan Stanojevic, Mile Markovic and Slobodan Ostojic is due to continue on September 4 and 5, as per the official timetable of the State Court. The four men are charged with detention and beating of civilians in the offence court and "Novi izvor" buildings.


On Thursday, September 4 the trial is due to continue in the case of Suljo Karajic, former member of the Bosnian Army, who is charged with crimes committed in Bihac. One day later the trial continues in the case of Marko Skrobic, former HVO member, who is charged with crimes committed in Kotor-Varos.
