28 August 2008 The State Prosecution files a custody extension motion in the case of Zoran Tomic due to fear that he might "intimidate the key witnesses" should he be released to liberty.
State Prosecutor Ibro Bulic filed a motion, requesting the extension of the custody of Zoran Tomic. He said that the Prosecution "has some indications that there have been attempts to influence and intimidate an important Prosecution witness, who is currently held in a Correctional Facility in Bosnia and Herzegovina, with an aim of preventing him from testifying".
The Prosecution charges Zoran Tomic, as member
of the Second Special Police Squad from Sekovici, with genocide against Srebrenica residents in 1995 and participating in the shooting of more
than 1,000 men in the Agricultural Cooperative hangars in Kravica. The indictee
has been held in custody since June 3 this year. The Court of Bosnia and
Herzegovina confirmed the indictment against him on August 25.
The public was excluded from the part of the hearing during which the participants discussed the allegations related to intimidation of witnesses. This was done in order to provide the Court with the name of the witness, who allegedly received threats, when someone told him that, "unless he withdrew his statements related to Srebrenica events in 1995, he would not see his children again."
Defence attorney Petko Pavlovic said that "there is no evidence" that could prove the indictee's participation in the intimidation of this witness, "who he does not know at all". He called on the Court to release Tomic from custody until the start of the trial.
The Court announced that it would pronounce its
custody extension decision at a later stage.
Prosecutor Ibro Bulic announced that the Tomic
case would be merged with the case against Radomir Vukovic, once the Court
confirms the indictment against him.
Vukovic is suspected of genocide in Srebrenica in 1995. He is currently held in custody, after having
been arrested in Serbia, as per a warrant issued by the Prosecution of Bosnia
and Herzegovina. He was extradited to local judicial bodies in late May.
The next hearing is due on September 9, when indictee Zoran Tomic will be asked to enter his plea.
