Bastah et al: Goran Viskovic released

23 July 2008  The Appellate Chamber of the State Court terminates the custody of the Vlasenica crimes indictee, ordering prohibiting measures instead.

The Appellate Chamber of the War Crimes Chamber upheld the appeal filed by Goran Viskovic's Defence attorney, terminating his custody and ordering certain prohibitive measures. The measures include a ban on performing any "official function in police or military agencies."

The State Prosecution charges Goran Viskovic and Predrag Bastah with having participated in "a plan of achieving a common goal," by committing murder, unlawful detention, mental and sexual abuse, torture and forcible disappearances of civilians from Vlasenica area from April to September 1992.

The prohibitive measures also incude a ban on leaving the place of residence, temporary seizure of travel documents, an obligation to report to the Public Safety Station in Vlasenica every day, a ban on contacting witnesses and potential witnesses, as well as other suspects, accessories and helpers in the commitment of the crime.

As per the decision made by the Appellate Chamber, Viskovic is not allowed to discuss the case with anybody else except his attorney, he is not allowed to visit the places in which the witnesses, mentioned in the indictment, reside, permanently or temporarily and he is prohibited from attending any social gatherings or visiting any coffee shops or restaurants.

Besides this, Viskovic is banned from performing any "business activities and official functions in any police or military agency," although the indictment does not say that he ever performed such jobs before.

Originally, the State Prosecution filed an indictment against Bastah, Viskovic and Veljko Basic, but the Trial Chamber decided, on the bases of a motion filed by the Defence and medical experts' findings, to separate the cases, because the indictee was not capable of following the trial.

The indictment alleges that Basic was manager of the Susica detention camp from May to September 1992. He allegedly had control over the lives and bodies of more than 1,000 prisoners.

Bastah, Viskovic and Basic were arrested in January 2008, as per a warrant issued by the State Prosecution. In July the Trial Chamber dismissed the prohibiting measures against Basic, whose health state is bad.

Predrag Bastah is still held in custody.
