
18 July 2008 The Trial Chamber reprimands the Prosecution, after a witness fails to appear in the courtroom.
The hearing at the trial of Krsto Savic and Milko Mucibabic was not held because a witness failed to appear.
As the Trial Chamber informed the people, who were present in the courtroom, after the witness failed to appear at the previously scheduled hearing she was contacted by phone. During the telephone conversation she said that she was "disabled," adding that she never had any contacts with the Prosecution and she did not know why she was invited to the trial.
"SIPA took a statement from this witness during the course of the investigation. We neither examined her nor established any contacts with her," Prosecutor Munib Halilovic said, adding that the State Investigation and Protection Agency, SIPA, did not inform the Prosecution that the witness was totally disabled.
"What the Prosecution has done is very unaccountable," Trial Chamber Chairwoman Minka Kreho said.
By the next hearing, scheduled for August 18, the Prosecution is due to contact the witness and check why she failed to appear at this hearing.
The Prosecution charges Savic and Mucibabic with having participated in crimes against civilians from Nevesinje, Kalnovik, Bileca and Gacko in the course of 1992. They are charged, among other things, with murder, rape, forced resettlement, disappearances, property demolition, detention, capture and physical and mental abuse of Bosniaks.
